This website is operated by SadShirtClub. Throughout these Terms, “we”, “us” and “our” refer to SadShirtClub.
These Terms of Service (“Terms”) govern your use of our website and purchases made through it.
By accessing our website or placing an order, you agree to these Terms together with the policies referenced on our website, including our Privacy Policy and Return & Refund Policy.
Nothing in these Terms affects your statutory rights as a consumer.
Our online store is powered by Shopify, which provides the ecommerce platform that enables us to sell our products and services.
1. Using Our Website
You may use our website only for lawful purposes.
You must not:
- use the website for illegal or fraudulent activity;
- attempt to gain unauthorised access to the website or related systems;
- transmit viruses, malware or other harmful code;
- interfere with the security or operation of the website;
- unlawfully collect information about other users; or
- infringe our intellectual property rights or those of another person.
We may restrict or terminate access where we reasonably believe the website is being misused.
2. Products
SadShirtClub sells clothing, jewellery, accessories and other products through our online store.
Some apparel is designed by SadShirtClub and may be printed, produced or fulfilled by us or by trusted production and fulfilment partners. Other products may be sourced from specialist suppliers.
We make reasonable efforts to ensure that product descriptions, photographs, specifications and other information are accurate.
Colours and appearance may vary slightly due to photography, screen settings, manufacturing processes or natural production variations.
Minor variations may also occur in products that are printed, produced or finished individually.
Nothing in this section affects your statutory rights where an item is faulty, damaged, not as described or otherwise fails to meet applicable legal requirements.
3. Prices
Product prices are displayed on our website and may change from time to time.
The price applicable to an order will normally be the price displayed when the order is placed.
Any applicable shipping charges or other costs will be displayed during checkout before you complete your purchase.
If an obvious pricing or listing error occurs, we may contact you to explain the problem and provide appropriate options. Where an order cannot reasonably be fulfilled because of an obvious error, we may cancel it and refund any amount already paid.
4. Orders
Submitting an order does not necessarily mean that we have accepted it.
We may decline or cancel an order where reasonably necessary, including where:
- a product is unavailable;
- payment cannot be authorised;
- incorrect pricing or product information has been displayed;
- we reasonably suspect fraudulent activity;
- delivery cannot reasonably be completed to the supplied address; or
- fulfilling the order would breach applicable law.
If we cancel an order after taking payment, the relevant amount will be refunded using the original payment method where reasonably possible.
We may also reasonably limit purchase quantities, including where we believe products are being purchased primarily for unauthorised resale.
5. Payment and Account Information
You agree to provide accurate and current information when placing an order.
You are responsible for ensuring that you are authorised to use the payment method supplied.
Payments may be processed by Shopify and/or third-party payment providers. We do not normally receive or store complete payment-card details ourselves.
If you create a customer account, you are responsible for keeping your login credentials secure.
6. Fulfilment and Delivery
Fulfilment methods can vary depending on the product and destination.
Products may be produced, packed or dispatched directly by SadShirtClub or by trusted production and fulfilment partners.
Estimated fulfilment and delivery times are estimates unless expressly stated otherwise.

Nothing in these Terms limits any delivery rights provided to you by applicable consumer law.
7. Returns, Refunds and Cancellation Rights
Returns, refunds and applicable cancellation procedures are explained in our Return & Refund Policy.
Our own return policy operates alongside your statutory consumer rights and does not replace or restrict them.
Different rules may apply to certain personalised, custom-made, sealed hygiene or other legally exempt products.

8. Custom and Personalised Products
Some products may be created or personalised specifically according to information supplied by you.
You are responsible for checking personalised information such as names, wording, sizes or other specifications before submitting your order.
Where a product has genuinely been made to your individual specifications or clearly personalised, statutory change-of-mind cancellation rights may not apply where permitted by law.
This does not affect your rights if the product is faulty, damaged or not as described.
9. Intellectual Property
Unless otherwise stated, original SadShirtClub branding, artwork, graphics, photographs, written content and other material created by or for SadShirtClub are protected by applicable intellectual property laws.
You may not reproduce, distribute, sell, commercially exploit or substantially copy our original material without permission.
Third-party names, trademarks, artwork and other intellectual property remain the property of their respective owners.
10. Reviews and User-Submitted Content
If you submit a review, photograph, comment or other content to SadShirtClub, you confirm that you have the right to submit that content.
You must not submit material that is unlawful, fraudulent, defamatory, abusive or infringes another person's intellectual property, privacy or other legal rights.
Where you submit content for publication, you grant SadShirtClub permission to display and use that content in connection with our store, products and marketing, subject to applicable law and our Privacy Policy.
We may moderate or remove submitted content where reasonably necessary.
11. Third-Party Services and Links
Our website may use or link to services operated by third parties, including payment providers, fulfilment companies, review services and other online platforms.
We are not responsible for the content, availability or practices of third-party websites that we do not control.
Third-party services may be governed by their own terms and privacy policies.

Our collection and processing of personal information is governed by our Privacy Policy.
Our store is hosted by Shopify, which also processes certain information as described in our Privacy Policy and Shopify's own privacy documentation.

We make reasonable efforts to keep information on our website accurate and our Services available.
However, we cannot guarantee that the website will always operate without interruption or technical errors.
We may update, modify, suspend or discontinue website features or products where reasonably necessary.
We may also correct genuine typographical errors, inaccuracies or omissions.
Nothing in this section permits us to remove or restrict rights that consumers have under applicable law.
14. Prohibited Uses
You must not use SadShirtClub or its Services:
- for unlawful or fraudulent purposes;
- to infringe intellectual property rights;
- to harass, threaten or unlawfully discriminate against another person;

Nothing in these Terms excludes or limits liability where doing so would be unlawful.
This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation and liabilities that cannot legally be excluded.
If you're purchasing as a consumer, nothing in these Terms limits your statutory rights.
We are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill where required by law.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed.
Where you use our website or purchase products wholly or mainly for business purposes, different legal rights and limitations may apply.
16. Events Outside Our Reasonable Control
We will not be responsible for delays or failures caused by circumstances outside our reasonable control, such as significant carrier disruption, severe weather, industrial action, major technical failures, natural disasters or government restrictions.
Where such circumstances affect an order, we'll take reasonable steps to minimise disruption and comply with any rights you have under applicable law.
17. Severability
If any provision of these Terms is found to be unlawful or unenforceable, that provision will be treated as removed or limited only to the extent necessary.
The remaining provisions will continue to apply.
18. Changes to These Terms
We may update these Terms occasionally to reflect changes to our business, website, Services or legal obligations.
The current version will be published on this page and the “Last updated” date will be changed where appropriate.
Changes will not retrospectively remove rights you already have in relation to an existing order.
19. Governing Law
These Terms are governed by the laws of England and Wales.
If you live elsewhere, you may also benefit from mandatory consumer protections provided by the laws applicable to you.
Nothing in these Terms prevents you from relying on mandatory consumer rights or protections that apply to your purchase.
